PROMOTION DESCRIPTION: The Check on You Music Video Contest (‘Sweepstakes’) begins on 2023-06-18 and ends on 2023-07-16 (the ‘Promotion Period’).

The sponsor of this Sweepstakes is Maurice Karst (‘Sponsor’). By participating in the Sweepstakes, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the Sweepstakes. Entrants should look solely to Sponsor with any questions, comments or problems related to the Sweepstakes. Sponsor may be reached by email at checkonyoucontest@mauricekarst.com during the Promotion Period.

ELIGIBILITY: Open to all individuals that have attained the age of majority in their local jurisdictions at the time of entry (the ‘Entrant’). Sponsor, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the ‘Promotion Entities’), are eligible to enter the Sweepstakes or win a prize. Household Members and Immediate Family Members of such individuals are also eligible to enter or win. ‘Household Members’ shall mean those people who share the same residence at least three months a year. ‘Immediate Family Members’ shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Sweepstakes is subject to all applicable laws and regulations and is void where prohibited or restricted by law. Entries are limited to 3 per ip address. This is a spam prevention measure and not an entry one. If several members in a household would each like to enter the contest this is possible as long as you use different ip addresses.

Family Photo Conditions: All pictures must include a minimum of a parent and a child to be considered a Family Photo. No additional logos, watermarks, captioning, or wording are allowed in the photo. It is expected that the picture will include family members in appropriate public attire. Swimsuits are ok if it is a beach or pool photo. Otherwise the photo must include no nudity or questionable poses. Regional differences in public attire are expected so for clarification these terms will outline the geographic area in question. The picture must be acceptable for use in public in Colorado, United States of America. If there are any questions about the acceptability of a photo just submit it to the contest and then email checkonyoucontest@mauricekarst.com and include the photo or a link to it so it can be reviewed. If there are any issues the option to include an alternate photo is only possible if the entrant sends an email to have the photo reviewed prior to the conclusion of the contest. Otherwise the photos are only reviewed if they win and at that time if a photo is found in violation of the terms the entrant loses their winning status and another entry is randomly chosen.

HOW TO ENTER Maurice Karst Check on You Mauricekarst.com managed Contest and the Instagram Contest: Enter the Sweepstakes during the Promotion Period online by visiting the entry form, which can be found on the following website at https://mauricekarst.com/promotions/check-on-you-contest/ Automated or robotic Entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant. Email address must be verified. Any attempt by Entrant to falsify an entry as another individual without their expressly given consent or to submit an image that is not of them personally or of their minor children will void all entries submitted by the individual regardless of legitimacy. Individuals attempting to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void Entrant’s Entries and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Promotion Period in order to participate. Sponsor’s database clock will be the official timekeeper for this Sweepstakes. All entries are simultaneously entered into the Maurice Karst Check on You Instagram Competition. Whether they choose to participate or not is optional. The Instagram contest requires additional steps for completion. Entrants must post the same picture uploaded to MauriceKarst.com to Instagram using #CheckOnYouForever so it can be located. Additional hashtags can be used however only CheckOnYouForever counts as a submission for the Instagram Contest. The picture can be cropped or resized as long as it is easily recognizable as the same.
Each action performed for an entry results in an additional chance at being picked so increases the odds.

DETAILS OF THE PRIZE: The winning entrants will have their family pictures included in the official Maurice Karst Check on You Youtube Music Video. The video will be posted on Youtube.com by the official Copyright Owner Maurice Karst which can be found at the url https://www.youtube.com/@mauricekarst with the 5 winners from the drawing and the 5 from the Instagram contest each being given a randomly chosen place in the video anywhere in between the beginning and the end but excluding the first and last photos. The first and last picture positions in the video are not included in this competition. WINNER SELECTION: The Winner(s) of the Sweepstakes will be selected in a random drawing from among all eligible Entries received throughout the Promotion Period using the entry form listed above in How To Enter. The random drawing will be conducted within a maximum of 7 days after the Promotion Period Programatically by the website contest software, Sponsor, or its designated representatives, whose decisions are final. 5 Winners will be chosen. Odds of winning will vary depending on the number of eligible Entries received. At the conclusion of the contest the top 5 most liked photos using #CheckOnYouForever will also be winners as well. If at the time any winning entrants are discovered to have violated the rules in any way they will be disqualified and another winner will be selected at random by Maurice Karst from the rest of the entries. Since that will also be random the process will repeat if that entry is also found to violate any rules. No Single Individual can win two submissions for the Music Video. If an individual entrant submission is randomly drawn for the competition and also gets the most likes on Instagram only the Instagram Selection will be deemed a winner. The other selection will be randomly chosen again to find an alternate winner.

WINNER NOTIFICATION: Winner will be notified by email at the email address provided in the Entry Information within a maximum of 7 days after the random drawing. Potential Winners must accept by email as directed by Sponsor within 7 days of notification. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any email account.

Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively ‘the Prize Claim Documents’). No substitution or transfer of a prize is permitted except by Sponsor.

PRIVACY: Submitting an entry to this contest does not create an account on MauriceKarst.com. An account is not required to enter. Any personal information supplied by you will be subject to the privacy policy located at https://mauricekarst.com/privacy-policy/ and by entering the Sweepstakes, you grant Sponsor permission to share your email address and any other personally identifiable information.

LIMITATION of LIABILITY: By entering, You agree to release and hold harmless Maurice Karst and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

DISPUTES: This Sweepstakes IS GOVERNED BY THE LAWS OF Colorado, United States, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Colorado based on Colorado laws having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees. Participant further waives all rights to have damages multiplied or increased.
